ROSÉ LASH TERMS OF CONDITIONS

These Terms of Service ("Terms") govern your access to and use of the ROSÉ LASH website and the purchase of products offered through the website.
This website is owned and operated by JST under the brand name ROSÉ LASH. Throughout these Terms, the terms "JST," "we," "us," and "our" refer to JST.
By accessing this website, placing an order, or purchasing products from us, you agree to be bound by these Terms, together with any policies referenced herein, including our Privacy Policy.
1. Formation of Contract

Your submission of an order constitutes an offer to purchase the selected products. By placing an order, you acknowledge your obligation to pay for the products ordered; however, JST is under no obligation to accept your order.
Upon receipt of your order, we will send an order confirmation email acknowledging receipt of your order. Such acknowledgment does not constitute acceptance of your order.
1.2
A binding contract shall be formed only when JST expressly accepts your order in writing or dispatches the ordered products, whichever occurs first.
Each contract relates only to the products expressly accepted by JST. JST reserves the right to decline or cancel any order prior to acceptance.

JST is a company duly organized and existing under the laws of the Republic of Korea, with its principal place of business located in Hwaseong-si, Gyeonggi-do, Republic of Korea.
4. Product Descriptions and Pricing
4.1
JST uses reasonable efforts to ensure that product descriptions, specifications, and images are accurate. However, minor variations may occur.
4.2
All prices displayed on the website are stated in the applicable currency and exclude shipping charges unless otherwise expressly stated.

Prices are subject to change without prior notice. Such changes shall not affect orders already accepted by JST.

If a pricing error is identified, JST reserves the right to correct the error, cancel the order, or contact the customer for further instructions.
If the correct price is lower than the stated price, JST will charge the lower amount.

JST reserves the right to withhold shipment until full payment has been received.
6. Product Availability and Delivery

Orders will be processed without undue delay. Unless otherwise agreed, products will normally be dispatched within fourteen (14) days after acceptance of the order.

JST shall not be liable for delays caused by customs authorities, carriers, weather conditions, force majeure events, government actions, labor disputes, or circumstances beyond JST's reasonable control.
6.3 Delivery Information
The Buyer is solely responsible for providing accurate and complete shipping and contact information.
JST shall not be liable for delivery failures or additional costs resulting from inaccurate information provided by the Buyer.
6.4 Customs Clearance
Unless otherwise expressly agreed in writing, all international shipments are made under DAP (Delivered At Place) – Incoterms® 2020.

If customs clearance is delayed, refused, or abandoned due to the Buyer's actions or omissions, JST reserves the right to recover all resulting expenses, including return freight, storage charges, customs fees, and disposal costs.
In such circumstances, product payments are non-refundable.
6.6 Returned Shipments
Products returned due to customs-related issues will not be reshipped unless the Buyer pays all applicable return handling charges and new shipping costs.
6.7 Customs Assistance
JST may provide general guidance regarding customs procedures; however, such assistance is provided solely as a courtesy.
The Buyer remains solely responsible for customs clearance, import compliance, product registration, certifications, taxes, and regulatory approvals required in the destination country.
7. Professional Adhesive Products
7.1
Professional eyelash adhesive products are intended exclusively for qualified professionals.
Improper use may result in serious injury, allergic reactions, or property damage.
7.2
JST reserves the right to request evidence of professional qualifications before accepting any order for professional adhesive products and may refuse or cancel any order at its sole discretion.
7.3
The Buyer acknowledges and accepts all risks associated with the purchase and use of professional adhesive products.
JST shall not be liable for injuries, allergic reactions, misuse, improper storage, improper application, or any damages arising from the use of such products.
8. Consumer Cancellation Rights
8.1
Where applicable under mandatory consumer protection laws, consumers may exercise statutory cancellation rights.
8.2
To cancel an order:

b. Return unused products in their original packaging within seven (7) days after receipt.
c. Orders already dispatched may only be refunded after the returned products have been received and inspected.
d. Bank fees, foreign exchange charges, or payment processing fees imposed by financial institutions are non-refundable.

If a product is confirmed to be defective, JST will provide an appropriate remedy, including repair, replacement, or refund, at its discretion and in accordance with applicable law.
Reasonable return shipping costs for confirmed defective products will also be reimbursed.

Nothing in these Terms excludes or limits liability that cannot legally be excluded.
To the fullest extent permitted by applicable law, JST shall not be liable for any indirect, incidental, consequential, special, punitive, or economic losses arising from the use of its products or services.

Personal information provided by customers will be collected, stored, processed, and protected using commercially reasonable security measures.
JST may verify customer information with third-party service providers for fraud prevention and payment verification purposes.

JST reserves the right to modify these Terms at any time to reflect changes in applicable laws, market conditions, technologies, payment methods, or business operations.

20. Governing Law and Jurisdiction
These Terms and any dispute arising out of or relating to these Terms or the purchase of products shall be governed by and construed in accordance with the laws of the Republic of Korea.
The courts of the Republic of Korea shall have exclusive jurisdiction over any disputes arising under these Terms.
